These Terms of Service ("Terms") govern your use of Tapn.vip. By using our service, you agree to these Terms.
1. Acceptance of Terms
By accessing or using Tapn.vip, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws. If you do not agree, do not use our service.
2. Eligibility
Age Requirement: You must be at least 13 years old to use Tapn.vip. If you are under 18, you must have parental consent.
3. Account Registration
- You must provide accurate and complete information
- You are responsible for maintaining account security
- You must not share your login credentials
- One person or business per account
- We reserve the right to refuse or terminate accounts
4. Subscription Plans
4.1 Plan Types
- Free: Basic features, 1 digital business card
- Business ($9/month): Unlimited cards, custom branding, lead capture, premium features
- Enterprise (Custom): White-label, team seats, SSO, dedicated support
4.2 Billing and Payment
- Subscriptions are billed monthly or annually
- Payments processed securely through Stripe
- Prices are in USD and subject to change with 30 days notice
- Wisconsin residents may be subject to applicable sales tax
4.3 Auto-Renewal
⚠️ IMPORTANT: Your subscription automatically renews at the end of each billing period unless you cancel. You will be charged the then-current rate.
4.4 Cancellation Policy
- You may cancel your subscription at any time
- Cancellation takes effect at the end of the current billing period
- No refunds for partial months
- Free plan continues after cancellation with limited features
4.5 Refund Policy
NO REFUNDS: All subscription payments are final and non-refundable, except as required by law or at our sole discretion.
5. Acceptable Use Policy
You agree NOT to:
- Use the service for illegal activities
- Upload malicious code or viruses
- Harass, threaten, or impersonate others
- Spam or send unsolicited communications
- Scrape or data mine our service
- Circumvent security measures
- Resell or redistribute our service
- Use automated systems without permission
- Violate intellectual property rights
- Post false, misleading, or defamatory content
6. Content Ownership
6.1 Your Content
- You retain ownership of content you upload
- You grant us a license to display and distribute your content
- You are responsible for your content
- We may remove content that violates these Terms
6.2 Our Intellectual Property
- Tapn.vip name, logo, and design are our trademarks
- Software and technology are proprietary
- You may not copy, modify, or reverse engineer our service
7. Privacy and Data
Your use of Tapn.vip is subject to our Privacy Policy. By using our service, you consent to our data practices.
8. Third-Party Services
- We integrate with third-party services (Stripe, social media, etc.)
- Third-party terms apply to their services
- We are not responsible for third-party services
9. Disclaimer of Warranties
Service provided "AS IS"
TAPN.VIP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of non-infringement
- Warranties of uninterrupted or error-free service
- Warranties of data accuracy or security
We do not guarantee uptime, data preservation, or that the service will meet your requirements.
10. Limitation of Liability
Maximum aggregate liability: one US dollar ($1.00)
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPN.VIP, GLOSSY BYRD MANAGEMENT LLC AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS AND PARTNERS SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, exemplary, punitive or consequential damages
- Loss of profits, revenue, data, goodwill, contracts, awards or business opportunities
- Service interruptions, payment or payout delays, or data loss
- Third-party actions, processors, hardware or content
Our total aggregate liability for all claims, in any form, shall not exceed one United States dollar (US $1.00). Where law does not permit this cap, liability is limited to the smallest amount the law allows. Feature-by-feature disclaimers are in our Legal Disclaimers, which form part of these Terms.
10A. Safety, Emergency & Tracking Features — Insurance Limits, Liability & Release of Damages
Not a substitute for emergency services — always call 911
Tapn.vip offers optional safety conveniences including the Family Tracker, geo-fencing safe zones, Bluetooth proximity features, the Emergency Medical ID (NFC), and family emergency alerts (collectively, "Safety Features"). By enabling any Safety Feature you acknowledge and agree:
- No guarantee of delivery: alerts, notifications, emails, location pings, and NFC scan events depend on device power, network coverage, GPS/Bluetooth availability, browser permissions, and third-party services, and may be delayed, inaccurate, or fail entirely.
- Not medical, security, or emergency service: Safety Features do not monitor, dispatch, or summon help. They are informational conveniences only.
- No insurance: Tapn.vip and Glossy Byrd Management LLC carry no insurance covering, and provide no coverage for, personal injury, death, property loss, or any harm connected to use of or reliance on Safety Features. Any insurance limits applicable to our general operations do not extend coverage to you or third parties.
- Release of all damages: to the maximum extent permitted by law, you release, waive, and discharge Tapn.vip, Glossy Byrd Management LLC, and their officers, employees, and agents from any and all claims, liabilities, and damages of every kind — including personal injury, wrongful death, and property damage — arising out of or related to the Safety Features, whether caused by failure, delay, inaccuracy, or otherwise.
- Assumption of risk: you use Safety Features voluntarily and at your own risk, and you are responsible for informing family circle members of these terms.
Section 10's overall liability cap ($100 or amounts paid in the prior 12 months) applies to Safety Features as well.
11. Indemnification
You agree to indemnify and hold harmless Tapn.vip from claims, damages, and expenses arising from:
- Your use of the service
- Your content
- Your violation of these Terms
- Your violation of others' rights
12. Termination
12.1 By You
You may terminate your account at any time by contacting support or using the account deletion feature.
12.2 By Us
We may suspend or terminate your account:
- For violation of these Terms
- For non-payment
- For fraudulent activity
- At our discretion with or without notice
12.3 Effect of Termination
- Your right to use the service ends immediately
- Your data may be deleted after 30 days
- No refund for remaining subscription period
- Sections 6, 9, 10, 11, 13, and 14 survive termination
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the State of Wisconsin and applicable federal laws, without regard to conflict of law principles.
13.2 Arbitration Agreement
Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except:
- Small claims court (under $5,000)
- Injunctive relief for IP violations
13.3 Class Action Waiver
YOU WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS. Disputes must be brought individually.
13.4 Venue
If arbitration doesn't apply, exclusive venue is in Wisconsin courts.
14. General Provisions
14.1 Entire Agreement
These Terms constitute the entire agreement between you and Tapn.vip.
14.2 Modifications
We may modify these Terms at any time. Material changes will be notified via email. Continued use constitutes acceptance.
14.3 Severability
If any provision is found invalid, the remaining provisions remain in effect.
14.4 No Waiver
Our failure to enforce any right does not waive that right.
14.5 Assignment
We may assign these Terms. You may not assign without our consent.
14.6 Force Majeure
We are not liable for delays or failures due to circumstances beyond our control.
