The Tapn.vip platform, website, mobile experiences, NFC hardware, content and every feature described below (the "Services") are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability or uninterrupted operation.
Nothing on the Services is legal, financial, tax, medical, procurement or other professional advice. You use the Services at your own risk and are solely responsible for decisions you make based on them.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF Tapn.vip, Glossy Byrd Management LLC, and their respective owners, officers, directors, employees, contractors, agents, affiliates, licensors, suppliers, partners and successors (together, the "Protected Parties") ARISING OUT OF OR RELATING TO THE SERVICES, THESE DISCLAIMERS OR THE TERMS OF SERVICE — WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE OR OTHERWISE — SHALL NOT EXCEED ONE UNITED STATES DOLLAR (US $1.00).
IN NO EVENT SHALL THE PROTECTED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, CONTRACTS OR AWARDS, EVEN IF ADVISED OF THEIR POSSIBILITY.
Some jurisdictions do not allow certain limitations; in those jurisdictions the Protected Parties' liability is limited to the smallest amount permitted by law. You agree the Services could not be offered at their price without these limits.
Payments are processed by Stripe (and PayPal or Shopify where offered), not by the Protected Parties. Tapn.vip never stores card numbers. Payment processors' own terms, fees, holds, reserves, disputes and payout timing apply, including fees for instant payouts.
Tapn.vip is a technology provider, not a party to any transaction between a member and their customer. Members are solely responsible for what they sell, for refunds, chargebacks, taxes, licences, and for complying with law and Stripe's prohibited-business rules. "Instant" or "immediate" availability of funds depends on the processor and your bank and is not guaranteed.
Emergency medical ID, health digests, appointment tools, family-safety and Continuity features are informational conveniences only. They are not medical devices, do not provide medical advice, diagnosis or treatment, and must never replace calling emergency services (911) or professional care.
Information is only as accurate and current as what you or your institution entered. Responders, clinicians and family members may not see or act on it. See Terms §10A for insurance limits and the release of damages for safety and tracking features.
The Vault uses encryption and version history, but no storage is immune to loss, corruption, unauthorised access or outage. Keep your own backups of anything important. Vault contents are not legal originals unless a competent authority says so, and the Protected Parties do not verify document authenticity.
AI Studio, proposal drafting, research assistants, Media Studio images/videos, matchmaking and automated decisions (filtering, scoring, categorising) are generated by machine models and can be inaccurate, incomplete, biased or out of date. Review everything before relying on it or submitting it to a buyer, agency or court.
You are responsible for the rights in prompts and uploads and for how you use generated output. Automated moderation or screening may occasionally hold legitimate content; decisions can be reviewed by Tapn.vip staff.
NFC performance depends on the customer's phone, operating system, case and settings; some devices cannot read or write tags. Tags can be lost, damaged or read by anyone who taps them — use the lost-card freeze promptly. Hardware is sold with the processor's or retailer's return policy only, with no further warranty.
Event organisers — not the Protected Parties — are responsible for their events, venues, safety, capacity, refunds and compliance. Geofenced door sales and badge check-in rely on device location and connectivity and may fail. Tickets are a licence from the organiser; Tapn.vip only transmits them.
The I AM THE FEATURE™ Academy, badges and Contract-Ready credentials recognise learning progress. They are not accreditation, certification by any government, a guarantee of contracts, awards, funding, employment or revenue, and do not replace required registrations (SAM.gov, state, local). Verifiable credentials prove issuance by Tapn.vip only.
Profiles, posts, reviews, spotlights, leaderboards and messages are created by members. The Protected Parties do not endorse, verify or guarantee any member, business, capability statement, review or offer, and are not responsible for user content or for dealings between members.
The Services integrate Stripe, PayPal, Shopify, Google, Resend, Twilio, AI model providers and other third parties and link to external sites. Their availability, terms and privacy practices are outside the Protected Parties' control.
NAICS, UEI, CAGE, certifications, pricing, Trust Center status and compliance alignment statements describe readiness or self-reported information and are not legal attestations, audits or guarantees of eligibility for any contract or programme unless an independent report is expressly linked.
You agree to defend, indemnify and hold harmless the Protected Parties from claims, losses, damages, fines and expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, your sales, events or dealings with others, or your breach of these disclaimers or the Terms. To the fullest extent permitted by law you release the Protected Parties from all claims relating to the matters above.
